Interim version — under legal review
This is the version currently in force and everything in it is accurate. Our registered company details and the name of our information officer are being confirmed in legal review and will be published here. In the meantime, anything in this document — including any request about your information — reaches us at support@melsoftacademy.com.
Terms of service
The terms on which we provide BEE Intelligence. Please read clause 3 in particular — it is the one that explains what the scorecard is. Effective 5 October 2026.
1.Who you are agreeing with
These terms are an agreement between you and Melsoft Academy (Pty) Ltd — 2022/502518/07, 173 Oxford Road, Rosebank, Sandton, Gauteng, 2196 (“we”, “us”). “The platform” means BEE Intelligence.
By creating an account you accept these terms. If you are using the platform for a company, you confirm you are authorised to accept them on its behalf.
2.What your account is
An account is created when you enter your name, work email and company name and then open the sign-in link we email you. There is no password. Anyone with access to your work email can sign in as you, so keep that inbox secure and tell us immediately if it is compromised.
A sign-in link can be used once, and is tied to the browser that requested it — for your security, a link opened on a different device will not work. Request a fresh one instead.
You must be 18 or older and must give us accurate details. One account belongs to one person; the data belongs to the company it was created for.
3.What the scorecard is, and what it is not
Everything this platform produces is an estimate: “Illustrative estimate · Not a verified B-BBEE score”. It is not a B-BBEE certificate, not a verification, and not a substitute for one. It carries no standing with any SANAS-accredited verification agency, with any organ of state, or with any customer assessing your B-BBEE status.
Your verification agency has final authority. If their result differs from ours, theirs is the one that counts.
We want to be specific about the limits rather than hide behind a general disclaimer:
- The scorecard is calculated out of 109 points using Generic Codes weightings. If a sector code applies to you, the platform says on screen that Generic weightings were used instead.
- Several element formulas are approximations of the Amended Codes rather than exact implementations, and each one is labelled as such in the platform. The “How this was calculated” screen names which.
- Any figure you do not enter is replaced by a labelled sample value. The platform tells you how many of your figures are real and how confident the estimate therefore is. An estimate built mostly on samples is not a measurement of your company.
- No SANAS-accredited agency has yet validated our calculations against a real verification. We are pursuing that; until it is done, treat the output as indicative.
Nothing on the platform is legal, financial, accounting or tax advice. Decisions with commercial consequences — what to spend, who to buy from, what to tell a customer — are yours, and you should take professional advice on them.
4.Your data, and what you may upload
The information you put in is yours. We use it to run the platform for you, as the privacy notice sets out. We do not sell it, and we do not use your figures to train anyone’s model.
When you upload documents or enter learner records you are giving us personal information about other people. You confirm you are entitled to do that. Please do not upload anything you do not need to: identity numbers, bank details and medical records are not required for a scorecard and should not be in the platform.
You may not use the platform to do anything unlawful, to break into it or to test its security without our written permission, to scrape it, or to resell it.
You may not present anything the platform produces to a third party as a verified B-BBEE result. Not to a customer, not in a tender, not to an organ of state. It is an estimate, and describing it as anything else misleads whoever you show it to and is a breach of these terms.
5.The AI Advisor and consultations
The AI Advisor sends your company name, your estimated score and the figures behind it to Anthropic to generate an answer. It is not sent your name, your email address, your learner records or your uploaded files. Its answers are generated text: they can be wrong, and they are not advice. Usage is rate limited.
A consultation booked through the platform is a conversation about your scorecard. It does not create a professional engagement unless we agree one separately in writing.
6.Availability
We will try to keep the platform available, but we do not promise uninterrupted service. We may change, suspend or withdraw features, and we may take it down for maintenance. If a change removes something you rely on, we will give you reasonable notice where we can.
7.Provided as it is, with no warranty
The platform is provided as it is and as available. To the fullest extent the law allows, we give no warranty — express or implied — that the estimate is accurate, complete, current, fit for any particular purpose, or that it will match the result of a verification. The limits in clause 3 are the reason, and they are stated there in detail rather than hidden here.
You accept that you are using an estimate produced from figures you supplied, by formulas that are in part approximations, and that have not been validated by a SANAS-accredited agency. If that is not an acceptable basis for a decision you need to make, do not make the decision on it.
8.Information you give us about other people
You are responsible for having a lawful basis to give us personal information about other people — your employees, your learners, anyone named in a document you upload — and for telling them as POPIA requires.
You agree to indemnify us against any claim, fine or loss arising from personal information you put into the platform without that basis, or from a document you upload that you were not entitled to share. This does not cover anything caused by our own breach of these terms or of the privacy notice.
9.What we are responsible for
We are responsible for providing the platform with reasonable skill and care, and for handling your information as the privacy notice describes.
We are not responsible for a decision you take on the basis of an estimate. To the fullest extent the law allows, we are not liable for loss of profit, loss of a contract or tender, loss of goodwill, or any indirect or consequential loss arising from your use of the platform — including where your actual verified B-BBEE result differs from the estimate shown here.
Where we are liable, our total liability is limited to the fees you paid us in the twelve months before the claim, or R1 000 if the platform was free to you.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud, or any right you have under the Consumer Protection Act 68 of 2008 where it applies to you.
10.Ending it
You can stop using the platform at any time, and ask us to close your account and delete your data by writing to support@melsoftacademy.com.
We may suspend or close your account if you break these terms, if we are required to by law, or if we stop offering the platform. We will give you notice and a chance to export your evidence pack unless the law prevents us.
11.Changes to these terms
We may update these terms. If a change materially affects you we will tell you by email before it takes effect. Continuing to use the platform after that means you accept the new version. The effective date at the top is the version in force.
12.Law and disputes
These terms are governed by South African law, and the South African courts have jurisdiction. Before going to court, please write to us — most things are quicker to fix by email.
